The suspect in the officer involved shooting on October 4, 2023, in the 4200 block of Surfwood Lane is 23-year-old, Deon Kwan Phillips Council-Rivera. Council-Rivera is being charged with the following:
Criminal Attempt 1st Degree Murder 3X, 1st Degree Assault, Criminal Attempt 1st Degree Assault, Menacing with a Deadly Weapon, 3rd Degree Assault, Child Abuse. The Pueblo County Sheriff’s Office is the lead investigative agency in this investigation conducted by the 10th Judicial Critical Incident Team (CIT).
Pueblo Police Chief Noeller’s Statement:
“Yesterday, officers in our department risked their lives for the safety and well-being of members of our community and one of them was shot and wounded in the process. Thankfully, those wounds are not life-threatening and after surgery last night, the officer is returning home today. This is a glaring example of the dangers the officers of the Pueblo Police Department and officers around the country face daily. I was impressed and am very proud of the response of our officers and thankful to the other agencies who responded to help during this dangerous incident. My family and I are praying for a speedy recovery from his injuries. I am asking for privacy for the officer who was wounded and his family. This has been a traumatic experience for our wounded officer, and everyone involved in the incident, and I would ask the public to continue keeping the officers and civilian employees of our department in their thoughts. The 10th Judicial District Critical Incident Team (CIT) has been activated, and we look forward to the results of a thorough and complete investigation into the actions that unfolded.”

On Wednesday, October 4th, 2023, at approximately 9:11 a.m., Pueblo Police were called to a report of a Domestic Violence with Weapons in the 4200 block of Surfwood Lane.
When the officers attempted to contact the suspect, the suspect opened fire at the officers. As a result of this gunfire, one officer was wounded. Although the wound is not life-threatening the officer was transported to a local hospital for medical treatment.
Police have the suspect in custody. This is still an active scene.
The 10th Judicial Critical Incident Team is investigating this incident along with the Colorado Bureau of Investigation and Colorado State Patrol.
