A bid is an irrevocable offer to purchase a municipal real property lien for assignment. The City of Pueblo reserves the right to pursue all available legal remedies against a non-paying bidder. Any non-paying bidder may be banned from future auctions. The opening bid includes all delinquent unpaid interest, penalties, fees, and costs owed to City. All fees have been added to the minimum bid, except for the five percent (5%) buyer’s premium. All sales are made by auction to the highest bidder. A bidder is legally and financially responsible for all lien sale and assignments bid upon whether acting as one’s self or acting as an agent. All bidders must be 18 years of age or older.
All sales are final and no refunds will be made. Liens are offered for sale “where is,” “as is,” and “without recourse,” without any representation of warranty, express or implied. Determination of lien type, priority of encumbrances, perceived or assumed value, potential costs of collection; and ownership, encumbrances, restrictions, zoning, condition, physical characteristics, availability of utilities, easements, or function of the Encumbered Property is the sole responsibility of the Buyer.
Encumbered Property parcels are subject to any easements and assessments of taxing districts and related government entities, deeds of trust, judgment liens, or encumbrances of any other kind or type that may affect real property, whether known or unknown. This means that any buyer is purchasing the Lien subject to any and all other encumbrances or debts that may affect the related parcel, whether recorded with the Pueblo County Clerk and Recorder’s office for legal notice or not. The City of Pueblo may require bid deposits as a way to decrease default bidding and ensure fairness and equity to all buyers. The deposit will be reversed if no default occurs or the bidder does not win the auction. Public Surplus will collect and retain the deposit if there is a default by the winning bidder.
A five percent (5%) Buyer’s Premium ($1 minimum) shall be added to the final sale price for each Lien purchased.
Payment in good funds (cash, cashier’s check or money order) is the only method of payment accepted. No partial payments are accepted. Payment in full for an awarded item must be received within seven (7) calendar days after the date of the Notice of Award of a successful bid. Payment in cash, cashier’s check, and money order should be made directly to the City’s Finance Department. More detailed payment instructions are contained within the Terms and Conditions. NO PERSONAL CHECKS, CREDIT CARD PAYMENTS, or WIRE TRANSFERS WILL BE ACCEPTED.
Once payment in full has been received, City will begin the process of executing and recording the Assignment of Lien(s) form with the Pueblo County Clerk and Recorder’s office. A copy of the recorded form will be provided to Buyer. Please be advised that this process may take several weeks post-auction to complete.
The City of Pueblo is not liable for the failure of any device that is not owned, operated, and managed by the City, which prevents a person from participating in any sale. “Device” includes, but is not limited to: computers and other equipment to access the internet, hardware, networks, software applications, and web sites.
The City of Pueblo retains the right to reject any and all bids for any reason, close the auction at any time, or withdraw any Lien from sale at any time prior to the date the Assignment of Lien(s) form is executed.
