
On Thursday, February 9, 2023, at approximately 5:48pm, officers were dispatched to the 1700 block of Constitution Rd. in reference to a fight. The reporting party told dispatchers there were two male parties fighting inside one of the apartments.
Upon arrival, officers saw a male, later identified as 42-year-old Joseph Montoya walking out of the apartment. At that point, a female pointed out Montoya as the suspect. Officers contacted Montoya and he immediately became uncooperative.
Officers contacted a male victim inside a residence who was covered in blood and unconscious on the floor. He was transported to a local hospital to be treated for his injuries.
After speaking with witnesses, it was learned the victim and Montoya met earlier in the day and the victim invited Montoya to his residence. A witness said when they talked to the victim over the phone later in the evening, the victim said to come to his residence right away. When they arrived, they observed the victim with obvious injuries to his face and bleeding. The victim explained they got into a fight over money they exchanged earlier.
Montoya was asleep on the couch and when asked to leave by the witness, Montoya punched her in the face two times. She then went outside and called 911.
Officers placed Montoya under arrest. He was booked into the Pueblo County Judicial Center for 2nd Degree Assault on the male victim, 3rd Degree assault on the female victim, and 3rd Degree assault for spitting on officers.
